Survivors' benefits under the Criminal Rehabilitation Act


Survivors of Germans who have suffered damage to their health as a result of a criminal decision by a German court in the territory referred to in Article 3 of the Unification Treaty (acceding territory = former GDR) which is contrary to the rule of law, or who have been admitted to a psychiatric institution in the former GDR, as a result of which they died, shall receive a survivor's pension in accordance with the provisions of the Federal Pensions Act (BVG).

A survivor's allowance can be granted if the deceased was prevented from pursuing a corresponding gainful occupation by the consequences of the injury.

Requirements

One of the preconditions for the granting of the benefit is that the unlawful decision has been annulled.
