Construction/ substantial modification of installations in the 20 m strip of a flood protection system

If you have a justified reason to use the area of a flood protection installation in up to 20 metres of its landward boundary for the construction or modification of an installation, you can, under certain circumstances, apply for an exemption from the ban on using flood protection installations.

§ Section 76 (1) of the Bremen Water Protection Act states that installations of any kind may not be constructed or substantially altered at a distance of up to 20 metres from the landward boundary of flood protection installations. Under certain conditions, the water authority of the Senator for the Environment, Construction and Transportation may grant an exemption on application. The party responsible for maintenance shall be heard.

								    

									    Requirements
The water authority may grant an exemption from the prohibition upon application if 


  • the prohibition in individual cases leads to an obviously unintended hardship,
  • the exemption is compatible with the interests of flood protection
