Notify employment of a pregnant or breastfeeding woman


Procedure

You must report the employment of a pregnant or breastfeeding woman digitally via the online service, in writing by e-mail or verbally.

When notifying via the online service:

  • You need a Business service account for this.
    • You can find the link to the login/registration under "Further information" - "Online service" - "Login/registration service account".
  • Before you can use the online service, please authorize your user.
    • You can find help under "Further information" - "Where can I find out more?" - "Maternity protection notification guide".
  • You can then use the "Maternity protection notification" online service
    • You will find the link under "Further information" - "Online service" - "Maternity protection notification".

For notification by e-mail:

  • Fill in the application form.
    • This can be found under "Further information" - "Forms".
  • Download it and fill it out.
  • You can provide information about the type and duration of your pregnant employee's employment in order to avoid any queries from the supervisory authority.
  • Send the notification by e-mail to the supervisory authority responsible for you.
  • As a rule, you will not receive a confirmation of receipt, as this is only a notification from you.

In the case of verbal notification:

  • You inform the authority of the pregnancy or breastfeeding period informally.

Legal bases

The Maternity Protection Act does not apply to

  • self-employed persons
  • board members and managing directors of legal entities or companies (unless they are also predominantly employed)
  • housewives

The reason for this is that they are not in an employment relationship.

There are special statutory regulations for the following professions:

  • Civil servants, judges and soldiers
